JYJ and their fans can now celebrate after Seoul’s Central District Court has dismissed SM Entertainment’s injunction against JYJ’s activities. It has been revealed that SM Entertainment’s application for the provisional suspension of JYJ’s activities were dismissed. On the 17th of February, the court declared that SM Entertainment can no longer restrict Jaejoong, Yoochun and Junsu of their activities.
“An exclusive contract between SM Entertainment and JYJ forces the members to be subordinate to SM, without any discretion about their activities. Under this, JYJ only has the option to obey, due to the rank and power of their agency. Thus, a long term contract to this effect will not be justified by the agency’s investment costs and risks associated with managing the group.”
“The injunction is invalid because of SM Entertainment’s ability to direct every move by the members. Additionally, the claim that the members must pay for the losses incurred by the situation only further illustrates the subordinate position of the members.”
